1. Acceptance of Terms
By accessing or using kaptura.ai, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use our service. You must be at least 18 years old to use this service.
2. Service Description
kaptura.ai is an AI-powered headshot generation service. You upload photos of yourself, and our AI creates professional headshots based on those photos. All headshots are generated using artificial intelligence and may contain imperfections inherent to AI-generated content. The service is provided on a per-session basis with a one-time payment.

4. Account & Access
You access the service by providing a valid email address and verifying it through a one-time code. You are responsible for maintaining the security of your email account and for all activities that occur under your account.
5. Photo Upload & Biometric Consent
You must upload photos of yourself (or have explicit permission from the person in the photos). By uploading photos and confirming at checkout, you provide explicit consent for kaptura.ai to process your facial photographs — including biometric data (facial geometry and features) — for the sole purpose of training a personalized AI model and generating your professional headshots. You may not upload photos of other people without their consent, photos of minors (under 18 years old), illegal or offensive content, or copyrighted material that you do not own. We reserve the right to refuse service if uploaded content violates these requirements. You may withdraw your biometric consent at any time by contacting us at hello@kaptura.ai, though this will prevent us from providing the service.
6. Payment & Pricing
The service is offered at the price displayed on our pricing page at the time of purchase. All payments are processed securely through Stripe. Invoices are generated automatically and sent to your email after purchase. Prices are subject to change, but any changes will not affect orders already placed. All prices are in USD unless otherwise stated.
7. Refund Policy
We offer a 3-day money-back guarantee. If you are not satisfied with your headshots, contact us within 3 days of delivery at hello@kaptura.ai for a full refund.
8. Intellectual Property
You retain ownership of the photos you upload. Upon delivery, you receive a full commercial license to use the AI-generated headshots for any personal or commercial purpose, including LinkedIn profiles, company websites, social media, printed materials, and any other use. We do not retain any rights over your generated headshots.
9. AI-Generated Content Disclosure
All headshots produced by kaptura.ai are generated using artificial intelligence. In accordance with transparency requirements, including Article 50 of the EU AI Act, we clearly label all AI-generated content. While we strive for high quality and accuracy, AI-generated images may contain imperfections. Results may vary depending on the quality and variety of photos you upload. You are responsible for disclosing the AI-generated nature of the headshots when required by applicable laws or regulations in your jurisdiction.
10. Prohibited Uses
You may not use the service to create deceptive or fraudulent identity documents, generate headshots of people without their consent, produce content that is illegal, harmful, or offensive, attempt to reverse-engineer or exploit the AI system, create deepfakes or misleading representations of other individuals, or resell the service without authorization.
11. Data Processing & Retention
Your uploaded selfies are automatically deleted from our storage once your headshots are generated. Our AI processing partner may retain training data for up to 30 days after generation, after which it is automatically deleted. 12. Limitation of Liability
kaptura.ai is provided “as is” without warranties of any kind. We are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you paid for the service. This limitation does not affect any rights that cannot be excluded under applicable consumer protection laws.
13. Governing Law
These terms are governed by the laws of the State of New York, United States. If you are a consumer in the European Economic Area, you also benefit from the mandatory consumer protection provisions of the laws of your country of residence. Any disputes shall be resolved in the courts of New York, New York, except where applicable consumer protection laws grant you the right to bring proceedings in your local courts.
14. Changes to Terms
We may update these terms from time to time. We will notify users of material changes by updating the “Last updated” date and, for significant changes, by notifying you via email. Continued use of the service after changes constitutes acceptance of the updated terms.
